Application Form. Complete the Application for Employment as an Independent Contractor Form, Form CMS-116, with the proper fees and the necessary documents attached as indicated on the form. If you provide services to children under 18, Form CMS-116 should be filed with the Department of Social Services. Who may file Form CMS-116? Children and their parents may file this form only if the form was filed for the services the children received for at least one month in a calendar year. Does Form CMS-116 need to be signed by the person who provided the service or a third party? No, this form is for filing for services and does not need to be signed by either the person who provided services or a third party (such as a health insurance company, school, or other employer). Does making a mistake on Form CMS-116 mean I am not entitled to social security benefits? No. Although an error or omission in Form CMS-116 may mean that you are not entitled to social security benefits, an applicant who is not entitled to social security benefits will have to file a Claim for Taxpayer Relief within 1 year from the date of the mistake to obtain relief. For noncommercial employment, a non-U.S. Citizen or Alien who completed the required training under the provisions of a program administered by a state department of education pursuant to ORS 673.101 which includes courses or programs that are appropriate for obtaining a certificate to operate a noncommercial vehicle. For commercial employment, a licensed, insured and insured out of state motor carrier of property (MO CPO) employee. For commercial driver training, the commercial driver training exam. Note: If a person was required to complete the Commercial Driver License (CDL), then the person must complete the CDL training. The CDL examination is given only to MO CPO employees. For foreign employment, a foreign national who received training as required by the Secretary of State. For foreign employment, a U.S. State Department employee, with authorization of the National Traffic Safety Administration, if the person is a U.S. State Department employee (National Traffic Safety Administration). Note: Under ORS 693, an employer who permits a U.S. citizen to work at or for the employer may not prohibit a foreign citizen from taking the CDL examination. All foreign passport applicants and recipients are required to complete a U.S. and foreign license for a noncommercial motor vehicle safety instructor or other training program. This training is the most complex part of the examination due to the subject. Note that when an applicant or person receives a foreign license it is valid for the period of validity of a license issued by the United States Government. For employment of a foreign national employed at the Office of Administrative Hearings and the Office of Special Appeals, they are not required to complete CDL training. When do I need to complete Form CMS-116?
You must complete Form CMS-116 by: The date the Form CMS-116 is received, The expiration date of your leave or For Federal employees who are receiving pay in a form other than a Form W-2, the date your workweek ends, including any week of overtime or compensatory time that would have been included in your pay without the leave (Note: Do not include a weekend or statutory holiday in the time-in-service calculation, unless it is part of a scheduled weekend or statutory holiday; see Exemptions) Do I need to submit the Form CMS-116 with my Form W-2? No. You can submit the Form CMS-116 with either Form W-2 or your pay stub form. Do I have to submit Form CMS-116 from each leave entitlement month with the information requested in its box? Yes, but Form CMS-116 does not include the leave number to which the leave is related. Thus, if a leave is considered a leave of absence with pay, you may choose to list the leave with pay number on Form CMS-116. If you listed the leave with pay number with your pay stub, you must submit Form CMS-116 if your leave is with pay. Am I required to have my Form CMS-116 completed on or before the filing due date? No. You may, however, need your Form CMS-116 to file by the due date for the current month if you wish to file a request for extension of leave under the Family and Medical Leave Act or the Affordable Care Act. Is there a limit on how many days I can take off without pay based on the number of weeks in my leave entitlement period? There is no maximum number of weekends or statutory holidays (other than federal holidays) that can be taken without pay under the FMLA (12(c)), which means that you may take as many holidays without pay from the first leave entitlement month back as needed for the current month. The following documents may be used to support your claim (and we will attach them to your Form CMS-116 as soon as possible): your Form 605 for the month you were covered by the State Children's Health Insurance Program (see the “How will I use the Information I Get On a Claim?” section below); current income Tax return for the last 3 tax years; proof of insurance coverage or a copy of your policy card; bank statements or other proof of financial security for the last 3 tax years; and A medical statement from a doctor with whom you have had a letter of health. You may use the current Form 605 and the Statement of Financial Security from your doctor to support claims that were made on or after April 4, 2011. In addition to the documentation listed above, you may also use the statements from any of your other health plans that are listed on section 9332a(c) of the Internal Revenue Code if you were not covered by any of your other health plans.
